tl;dr summary
ü  The federal criminal jury returns a verdict pursuant to (according to) Article III, Section 2, Clause 3 of the Constitution of the United States of America and the Sixth Amendment.
ü  The federal criminal jury may return a verdict in cases related to crimes punishable by over six months in prison and a $500 fine.
ü  The defendant may waive (give up) his right to a jury trial in favor of a bench trial = a trial before a judge.
ü  As a general rule a federal criminal jury consists of 12 persons. One of the exceptions occurs when after the jury has retired to deliberate; one member has to be excused by the judge for good cause (for a good reason, e.g. serious health problems). Then a jury of 11 may return a verdict.
ü  Potential jurors are examined (asked questions) by the court, by the attorney for the parties or by both, the court and the attorneys for the parties during the so called voir dire. As a consequence, potential jurors may be excluded from the proceedings by the court:
ü  when they are unable to render (provide) impartial (objective) jury service;
ü  when they are likely to disrupt the proceedings;
ü  when they are likely to threaten the secrecy of the proceedings, or otherwise (in a different way) adversely (negatively) affect the integrity (the process) of jury deliberations
ü  upon a peremptory challenge  made by one of the parties or
ü  upon a challenge for cause made by one of the parties.
ü  With peremptory challenges the parties do not have to provide a specific reason for excluding the juror. However, such exclusions may not be motivated by the race or gender of the juror. The number of peremptory challenges available to each party depends on the type of crime that the defendant is charged with. (1) In a capital case – when the prosecution seeks the death penalty, each party receives 20 peremptory challenges. (2) In other felony cases – when the defendant is charged with a crime punishable by imprisonment of more than one year, the government has 6 peremptory challenges and the defendant or defendants jointly have 10 peremptory challenges. (3) In a misdemeanor case – when the defendant is charged with a crime punishable by fine, imprisonment of one year or less, or both, each party has 3 peremptory challenges.
ü  A person may be challenged for cause if the examination shows he or she might be prejudiced. There is no limit to the number of challenges for cause, which either party may make.
ü  Jurors cannot take an active part in the proceedings. They may not ask questions or make objections.
ü  Before the jury retires to deliberate, the members are instructed on the law by the court. The parties may request in writing that the court instruct the jury on the specific law. The parties may object to any portion of the instructions or to a failure to give a requested instruction.
ü  The verdict must be unanimous (every member must vote in the same way): guilty or not guilty.
ü  The part of the trial when the judge asks each juror whether he or she agrees with the verdict is called the jury poll.
ü  If the members of the jury cannot agree on the verdict, the court declares a mistrial and the defendant may be later retried (tried again) before a different jury.

MORE TECHNICAL FUN FACTS
ü  Citizen names are taken from voter registration lists, lists of actual voters or other sources in order to form the so called master jury wheel.
ü  Names are drawn from the master jury wheel and the selected people are mailed the so called juror qualification forms, which they fill out and send back to the court.
ü  Prospective (potential) jurors must be citizens of the United States, of age (over 18), residents of a given judicial district for at least a year, able to read, write, understand and speak the English language as well as mentally and physically capable of serving as jurors. They may not have a charge pending against them for a crime punishable by imprisonment for more than one year. Past convicts (people who were convicted in the past) may serve as long as they haven’t lost their civil rights or they have had them restored.
ü  A person is declared unqualified for jury service when they don’t meet at least one of the above conditions.
ü  A person may be excused from jury service on individual request if the service could entail undue hardship or extreme inconvenience to this person or if they are volunteer safety personnel, i.e. firefighters or members of a rescue squad or ambulance crew.
ü  A person is exempt (a different name for excuse really, but a stronger one) from jury service if they are a member in active service in the Armed Forces of the United States; a member of the fire or police department or a public officer in the executive, legislative, or judicial branch. 
ü  Qualified candidates form the qualified jury wheel.
ü  Before a jury trial, names are drawn from the qualified jury wheel and the persons are mailed summonses (orders to appear in court).

SOURCE OF THE NAMES OF POTENTIAL JURORS

(…) specify whether the names of prospective jurors shall be selected from the voter registration lists or the lists of actual voters (…) (28 § 1863(b)(2) USC).

MASTER JURY WHEEL
(a) From time to time as directed by the district court, the clerk or a district judge shall draw at random from the master jury wheel the names of as many persons as may be required for jury service (28 § 1864(a) USC).
Okresowo (from time to time), zgodnie z wytycznymi (as directed) sądu dystryktowego, losowania z głównej puli nazwisk dokonuje urzędnik lub sędzia sądu dystryktowego w liczbie, która jest  każdorazowo wymagana (required)  (28 § 1864(a) USC).
QUALIFICATION FORM
The clerk or jury commission shall mail to every person whose name is drawn from the master wheel a juror qualification form accompanied by instructions to fill out and return the form, duly signed and sworn, to the clerk or jury commission by mail within ten days (28 § 1864(a) USC).
Osoby z listy otrzymują pocztą formularz kwalifikacyjny (juror qualification form) oraz (accompanied by) polecenie (instructions) wypełnienia, podpisania i odesłania (return) formularza w terminie dziesięciu dni (within ten days) (tytuł 28 § 1864(a) USC).
In any case in which it appears that there is an omission, ambiguity, or error in a form, the clerk or jury commission shall return the form with instructions to the person to make such additions or corrections as may be necessary and to return the form to the clerk or jury commission within ten days (28 § 1864(a) USC).
W przypadku, gdy formularz został wypełniony z pominięciem udzielenia jakiejś informacji (omission), nieudzieleniem jednoznacznej informacji (ambiguity) lub gdy został błędnie wypełniony (error), urzędnik lub komisja zwraca pocztą taki formularz z poleceniem naniesienia poprawek lub uzupełnienia brakującej informacji i odesłania formularza w terminie dziesięciu dni (tytuł 28 § 1864(a) USC).
A person summoned to appear because of failure to return a juror qualification form as instructed who personally appears and executes a juror qualification form before the clerk or jury commission may, at the discretion of the district court, except where his prior failure to execute and mail such form was willful, be entitled to receive for such appearance the same fees and travel allowances paid to jurors under section 1871 of this title (28 § 1864(a) USC).
Osoba wezwana (summoned) do stawienia się przed sądem (to appear) z powodu nieodesłania formularza (because of failure to return a juror qualification form) zgodnie z poleceniami sądu (as instructed), która stawia się osobiście (who personally appears) i dokonuje wypełnienia formularza przed (before) urzędnikiem lub komisją, jest uprawniona do wniesienia do sądu, za wyjątkiem, gdy niewypełnienie i nieodesłanie (failure to execute and mail) formularza nastąpiło z jej winy (willful), o rekompensatę (fees) i zwrot kosztów podróży (travel allowances) , które wypłacane są członkom ławy przysięgłych na podstawie sekcji 1871 tytułu 28 USC (tytuł 28 § 1864(a) USC).
 (h) “juror qualification form” shall mean a form prescribed by the Administrative Office of the United States Courts and approved by the Judicial Conference of the United States, which shall elicit the name, address, age, race, occupation, education, length of residence within the judicial district, distance from residence to place of holding court, prior jury service, and citizenship of a potential juror, and whether he should be excused or exempted from jury service, has any physical or mental infirmity impairing his capacity to serve as juror, is able to read, write, speak, and understand the English language, has pending against him any charge for the commission of a State or Federal criminal offense punishable by imprisonment for more than one year, or has been convicted in any State or Federal court of record of a crime punishable by imprisonment for more than one year and has not had his civil rights restored. The form shall request, but not require, any other information not inconsistent with the provisions of this title and required by the district court plan in the interests of the sound administration of justice. The form shall also elicit the sworn statement that his responses are true to the best of his knowledge. Notarization shall not be required. The form shall contain words clearly informing the person that the furnishing of any information with respect to his religion, national origin, or economic status is not a prerequisite to his qualification for jury service, that such information need not be furnished if the person finds it objectionable to do so, and that information concerning race is required solely to enforce nondiscrimination in jury selection and has no bearing on an individual’s qualification for jury service (28 §1869(h) USC).
Formularz kwalifikacyjny (juror qualification form) oznacza (shall mean) formularz , który spełnia wymagania (prescribed by) Urzędu Administracji Sądowej Stanów Zjednoczonych (the Administrative Office of the United States) i został zatwierdzony (approved) przez Konferencję Sądową (the Judicial Conference of the United States) i zawiera pola do wypełnienia (shall elicit) dotyczące nazwiska i imienia, adresu (address), wieku, rasy, wykonywanego zawodu (occupation), wykształcenia, okresu zamieszkania na terenie danego dystryktu, odległości miejsca zamieszkania (residence) od siedziby sądu (place of holding court), wcześniejszej służby w ławie przysięgłych (prior jury service) i obywatelstwa potencjalnego członka ławy przysięgłych, jak również pola dotyczące zwolnienia (excused or exempted) ze służby w ławie przysięgłych, fizycznej lub umysłowej choroby (physical or mental infirmity) uniemożliwiającej wypełnianie obowiązków członka ławy przysięgłych (impairing his capacity to serve as a juror), umiejętności czytania, mówienia w języku angielskim i rozumienia języka angielskiego ze słuchu, nierozstrzygniętego zarzutu (pending against him any charge) popełnienia przestępstwa stanowego lub federalnego zagrożonego karą pozbawienia wolności (punishable by imprisonment) od jednego roku lub prawomocnego wyroku skazującego (convicted) orzeczonego w sądzie stanowym lub federalnym zobowiązanym do archiwizacji akt (of record) w sprawie przestępstwa, za które grozi kara pozbawienia wolności od roku oraz nieprzywrócenia (not restored) praw publicznych (civil rights) wcześniej utraconych. W formularzu znajdują się pytania, na które udzielenie odpowiedzi nie jest obowiązkowe (shall request, but not require) i które nie stanowią naruszenia (not inconsistent with) przepisów tytułu 28 USC i są przewidziane w planie selekcji danego dystryktu ze względu na (in the interests of) dobro wymiaru sprawiedliwości (the sound administration of justice). Formularz zawiera również pole, w którym kandydat oświadcza pod przysięgą (shall elicit the sworn statement) , że udzielone odpowiedzi są zgodne z prawdą (true to the best of his knowledge). Poświadczenie notarialne (notarization) nie może być wymagane. Formularz musi w zrozumiały sposób informować kandydata, że udzielenie wszelkich informacji (furnishing of any information) dotyczących (in respect of) religii, narodowości i  statusu ekonomicznego nie stanowi warunku kwalifikacji (a prerequisite) do służby w ławie przysięgłych i że może zdecydować o nieudzieleniu tychże informacji, jeśli się temu sprzeciwia (if the person finds it objectionable), a także o tym, że udzielenie informacji dotyczącej rasy jest wyłącznie (solely) wymagane w celu zapewnienia przestrzegania (enforce) przepisów o zakazie dyskryminacji w procesie ustalania składu ławy przysięgłych (nondiscrimination in jury selection) i nie ma wpływu (has no bearing) na zakwalifikowanie kandydata (tytuł 28 §1869(h) USC).
SANCTIONS RELATED TO THE QUALIFICATION FORM

(b) Any person summoned pursuant to subsection (a) of this section who fails to appear as directed shall be ordered by the district court forthwith to appear and show cause for his failure to comply with the summons. Any person who fails to appear pursuant to such order or who fails to show good cause for noncompliance with the summons may be fined not more than $1,000, imprisoned not more than three days, ordered to perform community service, or any combination thereof. Any person who willfully misrepresents a material fact on a juror qualification form for the purpose of avoiding or securing service as a juror may be fined not more than $1,000, imprisoned not more than three days, ordered to perform community service, or any combination thereof (28 § 1864(b) USC).

Niestawiennictwo przed sądem w celu wypełnienia formularza kwalifikacyjnego skutkuje bezzwłocznym (forthwith) ponownym wezwaniem do sądu (order) i obowiązkiem usprawiedliwienia wcześniejszego niestawiennictwa (show cause for his failure to comply with the summons). Ponowne niestawiennictwo lub niemożność usprawiedliwienia wcześniejszego niestawiennictwa w sądzie może skutkować nałożeniem grzywny wynoszącej nie więcej niż 1000 dolarów, karą aresztu do trzech dni (imprisoned not more than three days) lub nałożeniem obowiązku wykonywania pracy na cele społeczne (ordered to perform community service), przy czym kary te mogą być nałożone łącznie (or any combination thereof). DISQUALIFYING POTENTIAL JURORS

(b) In making such determination the chief judge of the district court, or such other district court judge as the plan may provide, or the clerk if the court’s jury selection plan so provides, shall deem any person qualified to serve on grand and petit juries in the district court unless he—
(1) is not a citizen of the United States eighteen years old who has resided for a period of one year within the judicial district;
(2) is unable to read, write, and understand the English language with a degree of proficiency sufficient to fill out satisfactorily the juror qualification form;
(3) is unable to speak the English language;
(4) is incapable, by reason of mental or physical infirmity, to render satisfactory jury service; or
(5) has a charge pending against him for the commission of, or has been convicted in a State or Federal court of record of, a crime punishable by imprisonment for more than one year and his civil rights have not been restored (28 § 1865(b) USC).

Prezes sądu dystryktowego lub inny sędzia wyznaczony w planie selekcji albo urzędnik, gdy plan selekcji tak stanowi, zakwalifikuje osobę do odbycia służby jako członek wielkej lub małej ławy przysięgłych, o ile nie zachodzą przesłanki negatywne (unless), do których należą: (1) brak obywatelstwa Stanów Zjednoczonych, nieukończenie osiemnastego roku życia, fakt nie bycia mieszańcem (reside) obszaru właściwości danego sądu dystryktowego przynajmniej od roku (for a period of one year); (2) brak umiejętności (unable) czytania, pisania, rozumienia języka angielskiego ze słuchu w stopniu wystarczającym (with a degree of proficiency sufficient to) do wypełnienia formularza kwalifikacyjnego w sposób satysfakcjonujący (satisfactorily); (3) brak zdolności (incapable) posługiwania się językiem angielskim w mowie; (4) brak sprawności psychicznej lub fizycznej do wykonywania obowiązków członka ławy przysięgłych w stopniu satysfakcjonującym lub (5) postępowanie w toku lub prawomocny wyrok skazujący orzeczony w sądzie stanowym lub federalnym zobowiązanym do archiwizacji akt (of record) w sprawie przestępstwa, za które grozi kara pozbawienia wolności na ponad rok oraz bycie pozbawionym praw publicznych (tytuł 28 § 1865(b) USC).

QUALIFIED JURY WHEEL

(a) The chief judge of the district court, or such other district court judge as the plan may provide, on his initiative or upon recommendation of the clerk or jury commission, or the clerk under supervision of the court if the court’s jury selection plan so authorizes, shall determine solely on the basis of information provided on the juror qualification form and other competent evidence whether a person is unqualified for, or exempt, or to be excused from jury service. The clerk shall enter such determination in the space provided on the juror qualification form and in any alphabetical list of names drawn from the master jury wheel. If a person did not appear in response to a summons, such fact shall be noted on said list..

Prezes sądu dystrykowego lub inny sędzia (or such other district judge)  wyznaczony w planie selekcji (as the plan may provide), z własnej inicjatywy lub na zalecenie (upon recommendation) urzędnika lub komisji ds. ławy przysięgłych albo urzędnik pod nadzorem sądu, gdy plan selekcji tak stanowi (if the court’s jury selection plan so authorizes), oceni wyłącznie na podstawie informacji zawartych w wypełnionych formularzach kwalifikacyjnych i innego odpowiednio zgromadzonego materiału (other competent evidence), czy dana osoba kwalifikuje się do odbycia służby jako członek ławy przysięgłych, czy może być z niej zwolniona (exempt) ze względu na ochronę zdrowia, bezpieczeństwo lub dobro publiczne albo zwolniona (excused) ze względu na nadmierne trudności (undue hardship) lub wyjątkowe przeszkody (extreme inconvenience) w wypełnianiu obowiązków członka ławy przysięgłych. Urzędnik umieszcza tę informację w polu do tego wyznaczonym w formularzu kwalifikacyjnym, jak również na alfabetycznej liście nazwisk wyłonionych z głównej puli. Na liście umieszcza się również informację o niestawiennictwie po pierwszym wezwaniu sądu (in response to a summons) (tytuł 28 § 1865(a) USC).

SUMMONING POTENTIAL JURORS

(b) When the court orders a grand or petit jury to be drawn, the clerk or jury commission or their duly designated deputies shall issue summonses for the required number of jurors.
Each person drawn for jury service may be served personally, or by registered, certified, or first-class mail addressed to such person at his usual residence or business address (28 § 1866(b) USC).

Kiedy sąd wydaje postanowienie o wylosowaniu  członków wielkiej lub małej ławy przysięgłych, urzędnik lub komisja lub ich należycie wskazani zastępcy (duly designated deputies) wysyłają wezwania sądowe (issue summonses) wymaganej liczbie osób. Wezwania mogą być doręczane (served) osobiście albo listem monitorowanym (registered mail), listem poleconym (certified mail) lub listem zwykłym (first-class mail) na adres miejsca zwykłego pobytu (usual residence) lub adres pracy (business address) członka ławy przysięgłych (tytuł 28 § 1866(b) USC).

EXCUSING POTENTIAL JURORS

(...) specify those groups of persons or occupational classes whose members shall, on individual request therefor, be excused from jury service (...) jury service by such class or group would entail undue hardship or extreme inconvenience to the members thereof (...) (28 § 1863b5A USC).

Plan selekcji powinien również wskazać członków grup społecznych lub zawodowych, którzy na indywidualny wniosek (on individual request) będą mogli zostać zwolnieni (excused) z obowiązku zasiadania w ławie przysięgłych (jury service) ze względu na nadmierne trudności (undue hardship) lub wyjątkowe przeszkody (extreme inconvenience) w wypełnianiu obowiązków członka ławy przysięgłych (tytuł 28 § 1863b5A USC).

That any person summoned for jury service may be (1) excused by the court, or by the clerk under supervision of the court if the court’s jury selection plan so authorizes, upon a showing of undue hardship or extreme inconvenience, for such period as the court deems necessary, at the conclusion of which such person either shall be summoned again for jury service under subsections (b) and (c) of this section or, if the court’s jury selection plan so provides, the name of such person shall be reinserted into the qualified jury wheel for selection (…)

Osoba wezwana do odbycia służby w ławie przysięgłych może (1) być zwolniona (excused) przez sąd lub przez urzędnika pod nadzorem sądu jeśli plan selekcji na to zezwala/ tak stanowi, gdy osoba ta dowiedzie (upon a showing), że zasiadanie w ławie wiązałoby się z  nadmiernymi trudnościami lub, że istnieją wyjątkowe przeszkody, na okres, który sąd uzna za konieczny i z końcem którego osoba zostanie ponownie wezwana do pełnienia obowiązków członka ławy przysięgłych  albo, gdy plan selekcji przewiduje taką możliwość (if the court’s jury selection plan so provides) nazwisko osoby zostanie ponownie umieszczone na liście zakwalifikowanych kandydatów (tytuł 28 § 1866(c) USC).

 (...) specify that volunteer safety personnel, upon individual request, shall be excused from jury service. For purposes of this subparagraph, the term “volunteer safety personnel” means individuals serving (...) as firefighters or members of a rescue squad or ambulance crew (28 § 1863(b)(5)(B) USC).

Plan selekcji powinien zawierać postanowienie zwalniające członków publicznych służb ochotniczych na ich indiwidualny wniosek z obowiązku zasiadania w ławie przysięgłych. W niniejszym punkcie paragrafu określenie członkowie publicznych służb ochotniczych oznacza osoby pełniące służbę w (…) straży pożarnej, ratowniczej i pogotowiu ratunkowym (tytuł 28 § 1863(b)(5)(B) USC).

EXEMPTING POTENTIAL JURORS

 (...) specify that the following persons are barred from jury service on the ground that they are exempt: (A) members in active service in the Armed Forces of the United States; (B) members of the fire or police departments (...) (C) public officers in the executive, legislative, or judicial branches  (...) (28 § 1863(b) (6) USC).

Następujące grupy osób nie mogą zasiadać w ławie przysięgłych (barred from jury service), gdyż są z tego obowiązku zwolnione (exempt): (A) żołnierze w czynnej służbie wojskowej Stanów Zjednoczonych; (B) pracownicy oddziałów straży pożarnej lub policji (…) (C)urzędnicy państwowi władzy wykonawczej, ustawodawczej i sądowniczej (tytuł 28 § 1863(b) (6) USC).\

JURY TRIAL OR BENCH TRIAL

Rule 23. Jury or Nonjury Trial (Federal Rules of Criminal Procedure)
23(a) Jury Trial. If the defendant is entitled to a jury trial, the trial must be by jury unless:
(1) the defendant waives a jury trial in writing;
(2) the government consents; and
(3) the court approves.

Gdy oskarżonemu przysługuje proces z udziałem ławy przysięgłych, postępowanie przebiega z udziałem ławy przysięgłych chyba, że (1) oskarżony pisemnie zrzeknie się prawa (waives) do procesu z udziałem ławy przysięgłych; (2) oskarżyciel publiczny (the government)  wyrazi  na to zgodę a (3) sąd na to zezwoli (reguła 23(a)).

JURY SIZE

23(b) Jury Size.
(1) In General. A jury consists of 12 persons unless this rule provides otherwise.
(2) Stipulation for a Smaller Jury. At any time before the verdict, the parties may, with the court's approval, stipulate in writing that:
(A) the jury may consist of fewer than 12 persons; or
(B) a jury of fewer than 12 persons may return a verdict if the court finds it necessary to excuse a juror for good cause after the trial begins.
(3) Court Order for a Jury of 11. After the jury has retired to deliberate, the court may permit a jury of 11 persons to return a verdict, even without a stipulation by the parties, if the court finds good cause to excuse a juror.

(1) Ława przysięgłych składa się z dwunastu członków, o ile przepisy nie stanowią inaczej (unless this rule provides otherwise). 23(c) Nonjury Trial. In a case tried without a jury, the court must find the defendant guilty or not guilty. If a party requests before the finding of guilty or not guilty, the court must state its specific findings of fact in open court or in a written decision or opinion.

W postępowaniu bez udziału ławy przysięgłych sąd orzeka o winie lub braku winy oskarżonego (find the defendant guilty or not guilty). Na wniosek strony o uzasadnienie orzeczenia złożony przed jego ogłoszeniem, sąd uzasadnia orzeczenie ze wskazaniem ustaleń faktycznych (specific findings of fact), na których ono się opiera ustnie na rozprawie (in open court) lub pisemnie w formie wyroku/decyzji lub opinii (reguła 23(c)).

Rule 24. Trial Jurors
(a) Examination.
(1) In General. The court may examine prospective jurors or may permit the attorneys for the parties to do so.
(2) Court Examination. If the court examines the jurors, it must permit the attorneys for the parties to:
(A) ask further questions that the court considers proper; or
(B) submit further questions that the court may ask if it considers them proper.

EXCLUDING POTENTIAL JURORS

(…) or (2) excluded by the court on the ground that such person may be unable to render impartial jury service or that his service as a juror would be likely to disrupt the proceedings, or (3) excluded upon peremptory challenge as provided by law, or (4) excluded pursuant to the procedure specified by law upon a challenge by any party for good cause shown, or (5) excluded upon determination by the court that his service as a juror would be likely to threaten the secrecy of the proceedings, or otherwise adversely affect the integrity of jury deliberations (28 § 1866(c) USC)

Osoba (2) może być wyłączona (excluded) przez sąd z obowiązku zasiadania w ławie na podstawie istnienia obawy, że osoba ta może być niezdolna do zachowania bezstronności (unable to render impartial jury service) lub może zakłócić przebieg postępowania (likely to disrupt proceedings). Osoba może być również wyłączona (excluded) (3) na podstawie wniosku peremptoryjnego (peremptory challenge) w formie przewidzianej prawem lub (4) na podstawie wniosku z uzasadnieniem (a challenge for cause) którejkolwiek ze stron zgodnie przepisami prawa (specified by law). Na mocy przepisu 28 § 1866(c)(5) USC wyłączenie może również nastąpić ze względu na ustalenie przez sąd, że zasiadanie tej osoby w ławie przysięgłych zagraża tajności postępowania (likely to threaten the secrecy of the proceedings) lub może mieć negatywny wpływ innego rodzaju na przebieg narady członków ławy przysięgłych (otherwise adversely affect the integrity of jury deliberations (...) (tytuł 28 § 1866(c) USC)

PEREMPTORY CHALLENGES

(b) Peremptory Challenges. Each side is entitled to the number of peremptory challenges to prospective jurors specified below. The court may allow additional peremptory challenges to multiple defendants, and may allow the defendants to exercise those challenges separately or jointly.
(1) Capital Case. Each side has 20 peremptory challenges when the government seeks the death penalty.
(2) Other Felony Case. The government has 6 peremptory challenges and the defendant or defendants jointly have 10 peremptory challenges when the defendant is charged with a crime punishable by imprisonment of more than one year.
(3) Misdemeanor Case. Each side has 3 peremptory challenges when the defendant is charged with a crime punishable by fine, imprisonment of one year or less, or both.

Każda ze stron dysponuje (is entitled to) określoną poniżej (specified below) liczbą wniosków peremptoryjnych o wyłączenie potencjalnego członka ławy przysięgłych. Sąd może zezwolić na dodatkowe wnioski peremptoryjne, gdy oskarżonych jest więcej i może określić, że oskarżeni korzystają z wniosków osobno lub wspólnie (reguła 24(b))
(1) Każda ze stron dysponuje dwudziestoma wnioskami peremptoryjnymi, kiedy oskarżenie dotyczy przestępstwa, za które ustawa przewiduje karę śmierci (capital case) (reguła 24(b)(1)).

JURY INSTRUCTIONS

Rule 30. Jury Instructions
(a) In General. Any party may request in writing that the court instruct the jury on the law as specified in the request. The request must be made at the close of the evidence or at any earlier time that the court reasonably sets. When the request is made, the requesting party must furnish a copy to every other party.

Strona może pisemnie wnieść o poinstruowanie ławy przysięgłych o obowiązywaniu  konkretnych przepisów (on the law as specified in the request). Wniosek musi być złożony na koniec postępowania dowodowego (at the close of the evidence) lub w dowolnej chwili poprzedzającej ten moment (at any earlier time) wskazanej przez sąd. Strona wnosząca udostępnia odpis wniosku pozostałym stronom (must furnish a copy to every other party) (reguła 30 (a)).

(b) Ruling on a Request. The court must inform the parties before closing arguments how it intends to rule on the requested instructions.

Przed przemowami końcowymi (before closing arguments)  obu stron sąd informuje je, czy uwzględnia czy odrzuca wniosek o poinstruowanie ławy przysięgłych (how it intends to rule on the requested instructions) (reguła 30 (b)).

(c) Time for Giving Instructions. The court may instruct the jury before or after the arguments are completed, or at both times.

Sąd może poinstruować ławę przysięgłych przed rozpoczęciem przemówień końcowych, po ich zakończeniu lub w obu stadiach rozprawy (reguła 30 (c)).

(d) Objections to Instructions. A party who objects to any portion of the instructions or to a failure to give a requested instruction must inform the court of the specific objection and the grounds for the objection before the jury retires to deliberate. An opportunity must be given to object out of the jury's hearing and, on request, out of the jury's presence. Failure to object in accordance with this rule precludes appellate review, except as permitted under Rule 52(b).

Strona, która sprzeciwia się (objects to) dowolnej części (any portion of) instrukcji lub nieudzieleniu instrukcji, o którą wcześniej wnosiła (a failure to give a requested instruction), informuje sąd o konkretnym zarzucie (the specific objection) i jego podstawach zanim ława przysięgłych uda się na naradę (retires to deliberate). JURY VERDICT

Rule 31. Jury Verdict
(a) Return. The jury must return its verdict to a judge in open court. The verdict must be unanimous.

Ława przysięgłych musi wydać werdykt (return a verdict) wobec obecności sędziego (to a judge) na rozprawie jawnej (in open court). Werdykt musi być jednomyślny (unanimous) (reguła 31(a))

(b) Partial Verdicts, Mistrial, and Retrial.
(1) Multiple Defendants. If there are multiple defendants, the jury may return a verdict at any time during its deliberations as to any defendant about whom it has agreed.

Jeśli w sprawie występuje więcej niż jeden oskarżony, ława może wydać werdykt dotyczący/ w stosunku do jednego z nich (as to any defendant) w dowolnym momencie w trakcie swojej narady (at any time during its deliberations), gdy osiągnie co do niego jednomyślność (about whom it has agreed) (reguła 31(b)(1)).

(2) Multiple Counts. If the jury cannot agree on all counts as to any defendant, the jury may return a verdict on those counts on which it has agreed.

Jeśli ława przysięgłych nie może uzyskać jednomyślności w stosunku do wszystkich zarzutów (counts) któregoś z oskarżonych, ława przysięgłych może wydać werdykt dotyczący zarzutów (on those counts) co do których osiągnęła jednomyślność (on which it has agreed) (reguła 31(b)(2)).
(3) Mistrial and Retrial. If the jury cannot agree on a verdict on one or more counts, the court may declare a mistrial on those counts. The government may retry any defendant on any count on which the jury could not agree.

Jeśli ława przysięgłych nie może uzyskać jednomyślności (cannot agree) w stosunku do jednego lub kilku zarzutów, sąd może unieważnić przewód sądowy co do tych zarzutów (declare a mistrial). Oskarżyciel (the government) może ponownie wnieść zarzuty (retry any defendant), co do których ława przysięgłych nie osiągnęła jednomyślności (on any count on which the jury could not agree) (reguła 31(b)(3))

(c) Lesser Offense or Attempt. A defendant may be found guilty of any of the following:
(1) an offense necessarily included in the offense charged;
(2) an attempt to commit the offense charged; or
(3) an attempt to commit an offense necessarily included in the offense charged, if the attempt is an offense in its own right.

Oskarżony może zostać uznany za winnego (found guilty): (1) popełnienia przestępstwa zagrożonego niższym wymiarem kary i naruszającego to samo dobro co przestępstwo określone w akcie oskarżenia (offense necessarily included in the offense charged); (2) usiłowania popełnienia przestępstwa określonego w akcie oskarżenia (an attempt to commit the offense charged); (3) usiłowania popełnienia czynu zagrożonego niższym wymiarem kary i naruszającego to samo dobro co przestępstwo określone w akcie oskarżenia, jeśli samo usiłowanie stanowi osobne przestępstwo (an attempt to commit an offense necessarily included in the offense charged) (reguła 31(c))

(d) Jury Poll. After a verdict is returned but before the jury is discharged, the court must on a party's request, or may on its own, poll the jurors individually. If the poll reveals a lack of unanimity, the court may direct the jury to deliberate further or may declare a mistrial and discharge the jury. 

Po wydaniu werdyktu i przed zwolnieniem członków ławy przysięgłych z dalszego pełnienia obowiązków (before the jury is discharged), sąd musi na wniosek strony (on a party’s request) lub może z własnej inicjatywy (on its own) poprosić każdego członka ławy przysięgłych z osobna o potwierdzenie werdyktu (poll the jurors individually). Jeśli wyjdzie na jaw brak jednomyślności (a lack of unanimity), sąd może nakazać członkom ławy przysięgłych, aby powrócili do obradowania (deliberate further) lub może uznać przewód sądowy za nieważny (declare a mistrial) i zwolnić członków ławy przysięgłych z dalszego pełnienia obowiązków (discharge the jury) (reguła 31(d)).
