ENG: a group of between sixteen and twenty-three people whose task is to decide whether enough evidence has been provided by the prosecution to charge a person with a serious crime

ü  The grand jury is appointed pursuant to the Fifth Amendment.
ü  The grand jury is appointed when the prosecution wishes to charge an individual with a felony (a serious crime), which is punishable by death or by imprisonment for more than one year.
ü  The grand jury determines whether there is probable cause to believe that a crime was committed and that a specific person or persons committed it.
ü  If the grand jury determines that there is enough evidence to formally accuse a person of a crime, the foreperson (representative) of the grand jury signs the so called indictment.
ü  If the person under investigation waives (gives up the right to) prosecution by indictment, he or she is prosecuted by way of the document called “information”, without an investigation by the grand jury.
ü  12 out of 16-23 people need to concur in indictment, i.e. agree that criminal charges need to be brought against an individual for the indictment to be issued (true bill). If fewer than 12 people vote for indicting the person, the case does not proceed to the court (no bill).
ü  The court does not participate in the proceedings before the grand jury.
ü  The proceedings before the grand jury are secret. The persons who may be present while the grand jury is in session are: attorneys for the government (the prosecutors), the witness being questioned, interpreters when needed, and a court reporter or an operator of a recording device.
ü  The person under investigation does not usually participate in the proceedings before the grand jury unless he or she is called as a witness.

SUMMONING A GRAND JURY

Rule 6. The Grand Jury
(a) Summoning a Grand Jury.
(1) In General. When the public interest so requires, the court must order that one or more grand juries be summoned. A grand jury must have 16 to 23 members, and the court must order that enough legally qualified persons be summoned to meet this requirement.

Kiedy wymaga tego interes publiczny (When the public interest so requires), sąd zarządza powołanie określonej liczby składów wielkiej ławy przysięgłych. Wielka ława przysięgłych liczy od szesnastu do dwudziestu trzech członków, a w obowiązku sądu (the court must) jest zarządzenie (order) wezwania do stawiennictwa (summon) wystarczającej liczby osób którzy spełniają warunki określone prawem (legally qualified) (reguła 6 (a)(1)).

Every grand jury impaneled before any district court shall consist of not less than sixteen nor more than twenty-three persons (18 § 3321 USC).

Wielka ława przysięgłych powoływana (impaneled)  przez sąd dystryktowy liczy (shall consist of) od szesnastu do dwudziestu trzech członków (tytuł 18 § 3321 USC).

GRAND JURY INDICTMENT/ TYPE OF CRIMES

(1) Felony. An offense (other than criminal contempt) must be prosecuted by an indictment if it is punishable:
(A) by death; or
(B) by imprisonment for more than one year.

Postępowanie w sprawie popełnienia przestępstwa (wyłączając przestępstwo przeciwko wymiarowi sprawiedliwości) (other than criminal contempt) musi zostać wszczęte drogą aktu oskarżenia wielkiej ławy przysięgłych (must be prosecuted by an indictment), jeśli jest to przestępstwo: (A) zagrożone karą śmierci lub (B) karą pozbawienia wolności na czas dłuższy niż jeden rok (reguła 7(a)(1)).

WAIVING THE RIGHT TO PROSECUTION BY INDICTMENT

(b) Waiving Indictment. An offense punishable by imprisonment for more than one year may be prosecuted by information if the defendant—in open court and after being advised of the nature of the charge and of the defendant's rights—waives prosecution by indictment.

Postępowanie w sprawie popełnienia przestępstwa zagrożonego karą pozbawienia wolności na czas dłuższy niż jeden rok (punishable by imprisonment for more than one year) może być wszczęte drogą aktu oskarżenia sporządzonego z wyłączeniem postępowania przed wielka ławą przysięgłych (by information) pod warunkiem, że osoba – na jawnej rozprawie (in open court) i będąc wcześniej pouczoną (after being advised) o zarzutach jej stawianych i o prawach jej przysługujących – zrzeka się prawa do postępowania przed wielką ławą przysięgłych (waives prosecution by indictment) (reguła 7(b)).

FOREPERSON AND DEPUTY FOREPERSON

(c) Foreperson and Deputy Foreperson. The court will appoint one juror as the foreperson and another as the deputy foreperson. In the foreperson's absence, the deputy foreperson will act as the foreperson. The foreperson may administer oaths and affirmations and will sign all indictments. The foreperson—or another juror designated by the foreperson—will record the number of jurors concurring in every indictment and will file the record with the clerk, but the record may not be made public unless the court so orders.

Sąd ustanowi (appoint) jednego członka wielkiej ławy przysięgłych jej przewodniczącym (foreperson), a innego zastępcą przewodniczącego (deputy foreperson) W przypadku nieobecności przewodniczącego, jego zastępca wykonuje obowiązki (act as) przewodniczącego. THE PROCEEDINGS

 (1) While the Grand Jury Is in Session. The following persons may be present while the grand jury is in session: attorneys for the government, the witness being questioned, interpreters when needed, and a court reporter or an operator of a recording device.
Następujące osoby mogą być obecne podczas postępowania przed wielką ławą przysięgłych: prokuratorzy (attorneys for the government), przesłuchiwany właśnie świadek, tłumacze o ile ich obecność jest potrzebna oraz protokolant lub osoba obsługująca sprzęt do rejestracji (reguła 6 (d)(1)).

THE DELIBERATION

(2) During Deliberations and Voting. No person other than the jurors, and any interpreter needed to assist a hearing-impaired or speech-impaired juror, may be present while the grand jury is deliberating or voting.

Nikt poza członkami wielkiej ławy przysięgłych i tłumaczy potrzebnych ze względu na członka, który ma wadę słuchu (hearing-impaired) lub zaburzenia mowy (speech-impaired) nie ma prawa być obecny w trakcie (while) narady (deliberating) lub głosowania członków (reguła 6 (d)(2)).

THE INDICTMENT 

f) Indictment and Return. A grand jury may indict only if at least 12 jurors concur. The grand jury—or its foreperson or deputy foreperson—must return the indictment to a magistrate judge in open court. To avoid unnecessary cost or delay, the magistrate judge may take the return by video teleconference from the court where the grand jury sits.

Wielka ława przysięgłych może postawić w stan oskarżenia tylko, gdy dwunastu jej członków zgodnie w ten sposób zagłosuje (concur). Wielka ława przysięgłych lub jej przewodniczący (the foreperson) albo zastępca przewodniczącego (the deputy foreperson)  stawia osobę w stan oskarżenia (must return the indictment) w obecności sędziego (magistrate judge) na posiedzeniu jawnym (in open court). W celu uniknięcia zbędnych kosztów i przewlekłości postępowania (To avoid unnecessary cost or delay) sędzia (the magistrate judge) może wziąć udział w procedurze postawienia w stan oskarżenia (may take the return) przy użyciu urządzeń technicznych (by video teleconference) na odległość (from the court where the jury sits) (reguła 6(f)).

RECORDING THE PROCEEDINGS

(e) Recording and Disclosing the Proceedings.
(1) Recording the Proceedings. Except while the grand jury is deliberating or voting, all proceedings must be recorded by a court reporter or by a suitable recording device. But the validity of a prosecution is not affected by the unintentional failure to make a recording. Unless the court orders otherwise, an attorney for the government will retain control of the recording, the reporter's notes, and any transcript prepared from those notes.

Przebieg postępowanie poza czasem trwania narady i głosowania (Except while the grand jury is deliberating or voting) musi zostać zarejestrowany (must be recorded) przez protokolanta (by a court reporter) lub przez odpowiedni sprzęt do rejestracji (or by a suitable recording device). Jednakże nieumyślne nienagranie przebiegu postępowania (the unintentional failure to make a recording) nie wpływa na ważność oskarżenia (But the validity of a prosecution is not affected). O ile sąd nie postanowi inaczej (Unless the court orders otherwise) prokurator (attorney for the government) dysponuje nagraniem (will retain control of the recording), notatkami protokolanta i wszelkich transkryptów sporządzonych na podstawie notatek (reguła 6 (e)(1)).

MORE ABOUT THE SECRECY OF THE PROCEEDINGS

(2) Secrecy.
(A) No obligation of secrecy may be imposed on any person except in accordance with Rule 6(e)(2)(B).

Obowiązek zachowania tajemnicy (obligation of secrecy) może być nałożony (imposed) jedynie zgodnie z przepisami reguły 6(e)(2)(b)  (reguła 6(e)(2)(a)).

(B) Unless these rules provide otherwise, the following persons must not disclose a matter occurring before the grand jury:
(i) a grand juror;
(ii) an interpreter;
(iii) a court reporter;
(iv) an operator of a recording device;
(v) a person who transcribes recorded testimony;
(vi) an attorney for the government; or
(vii) a person to whom disclosure is made under Rule 6(e)(3)(A)(ii) or (iii).

O ile niniejsze przepisy nie stanowią inaczej (Unless these rules provide otherwise) następujące osoby nie mogą ujawniać informacji o przebiegu postępowania przed wielką ławą przysięgłych (must not disclose a matter occurring before the grand jury): członek wielkiej ławy przysięgłych, tłumacz, protokolant, osoba obsługująca sprzęt do rejestracji, osoba dokonująca transkryptu zarejestrowanych zeznań, prokurator i osoba, która otrzymuje informację na mocy reguł6 (e)(3)(A)(ii) lub (iii) (reguła 6(e)(2)(b)).

(3) Exceptions.
(A) Disclosure of a grand-jury matter—other than the grand jury's deliberations or any grand juror's vote—may be made to:
(i) an attorney for the government for use in performing that attorney's duty;
(ii) any government personnel—including those of a state, state subdivision, Indian tribe, or foreign government—that an attorney for the government considers necessary to assist in performing that attorney's duty to enforce federal criminal law; or
(iii) a person authorized by 18 U.S.C. §3322.

Ujawnienie informacji o przebiegu postępowania przed wielką ławą przysięgłych (Disclosure of a grand-jury matter) z wyjątkiem (other than) przebiegu narady i głosowania może nastąpić wobec (may be made to):  (i) prokuratora (attorney for the government) w celu umożliwienia mu wykonywania swoich obowiązków (for use in performing that attorney's duty); (ii) pracowników władz rządowych do których zaliczają sie urzędnicy władz stanowych, władz lokalnych, plemion indiańskich, obcych rządów, których pomoc według oceny prokuratora jest niezbędna (that an attorney for the government considers necessary to assist) do wykonywania jego obowiązków związanych z zagwarantowaniem przestrzegania przepisów prawa karnego federacji (enforce federal criminal law); lub (iii) osoby, której nadano kompetencję na mocy (a person authorized by) sekcji 3322 tytułu 18 USC (reguła 6(e)(3)(A)).

(B) A person to whom information is disclosed under Rule 6(e)(3)(A)(ii) may use that information only to assist an attorney for the government in performing that attorney's duty to enforce federal criminal law. An attorney for the government must promptly provide the court that impaneled the grand jury with the names of all persons to whom a disclosure has been made, and must certify that the attorney has advised those persons of their obligation of secrecy under this rule.

Osoba, która otrzymuje informacje na mocy (A person to whom information is disclosed under) reguły 6 (e)(3)(A)(ii) może użyć tych informacji jedynie w celu pomocy (only to assist) przedstawicielowi rządu (attorney for the government)  w wykonywaniu jego obowiązków (in performing that attorney's duty) związanych z zagwarantowaniem przestrzegania przepisów prawa karnego federacji (to enforce federal criminal law). Prokurator bezzwłocznie informuje sąd, który powołał wielką ławę przysięgłych (must promptly provide the court that impaneled the grand jury with) o nazwiskach osób, którym ujawniono informacje (to whom a disclosure has been made) i potwierdza (must certify), że pouczył je o obowiązku zachowania tajemnicy (has advised those persons of their obligation of secrecy under this rule) zgodnie z wyżej wymienioną regułą (reguła 6(e)(3)(B)).

(C) An attorney for the government may disclose any grand-jury matter to another federal grand jury.

Prokurator może ujawnić informacje o przebiegu postępowania przed wielką ławą przysięgłych (any grand-jury matter) innej wielkiej ławie przysięgłych sądu federalnego (reguła 6(e)(3)(C)).

(D) An attorney for the government may disclose any grand-jury matter involving foreign intelligence, counterintelligence (…), or foreign intelligence information (…) to any federal law enforcement, intelligence, protective, immigration, national defense, or national security official to assist the official receiving the information in the performance of that official's duties.

Prokurator może ujawnić informacje o przebiegu postępowania przed wielką ławą przysięgłych (may disclose any grand-jury matter), które dotyczą agencji wywiadu (foreign intelligence) lub agencji kontrwywiadu  (counterintelligence) pracownikom federalnych służb ścigania (to any federal law enforcement), wywiadu (intelligence), ochrony (protective,) imigracji, obrony narodowej (national defense), narodowego bezpieczeństwa (national security) w celu pomocy (to assist) temu przedstawicielowi służby (official)  w wykonywaniu jego obowiązków (in the performance of that official's duties).

 An attorney for the government may also disclose any grand-jury matter involving, within the United States or elsewhere, a threat of attack or other grave hostile acts of a foreign power or its agent, a threat of domestic or international sabotage or terrorism, or clandestine intelligence gathering activities (…) (to any appropriate federal, state, state subdivision, Indian tribal, or foreign government official, for the purpose of preventing or responding to such threat or activities.

Prokurator może również ujawnić informacje o przebiegu postępowania przed wielką ławą przysięgłych dotyczących wewnętrznego lub zagranicznego (within the United States or elsewhere)  zagrożenia ataku (a threat of attack) lub innych poważnych wrogich aktów sił obcych  (other grave hostile acts of a foreign power), krajowego lub międzynarodowego zagrożenia sabotażu (a threat of domestic or international sabotage) lub terroryzmu (terrorism) i zagrożenia działalnością tajnego wywiadu (clandestine intelligence gathering activities) urzędnikom władz stanowych, władz lokalnych (state subdivision), plemion indiańskich (Indian tribal), obcego rządu (foreign government official) w celu zapobieżenia lub odpowiedzi na takie zagrożenie lub działalność (for the purpose of preventing or responding to such threat or activities)(reguła 6(e)(3)(D)).

(i) Any official who receives information under Rule 6(e)(3)(D) may use the information only as necessary in the conduct of that person's official duties subject to any limitations on the unauthorized disclosure of such information (…) only in a manner consistent with any guidelines issued by the Attorney General and the Director of National Intelligence.

Urzędnik, który otrzyma tajne informacje na podstawie reguły 6(e)(3)(D) może użyć tych informacji / wykorzystać te informacje tylko, jeśli jest to konieczne do wykonywania jego obowiązków (in the conduct of that person's official duties) z zastrzeżeniem zasad dotyczących ograniczenia ujawniania tajnych informacji (subject to any limitations on the unauthorized disclosure of such information) i tylko w sposób zgodny z wytycznymi (only in a manner consistent with any guidelines issued by) Prokuratora Generalnego (the Attorney General) i Dyrektora Wywiadu Narodowego (Director of the National Intelligence) (reguła 6(e)(3)(D)(i)).

(ii) Within a reasonable time after disclosure is made under Rule 6(e)(3)(D), an attorney for the government must file, under seal, a notice with the court in the district where the grand jury convened stating that such information was disclosed and the departments, agencies, or entities to which the disclosure was made.

W rozsądnym terminie od (Within a reasonable time after) ujawnienia tajnych informacji zgodnie z zasadą 6(e)(3)(D), prokurator ma obowiązek drogą utajnionego dokumentu powiadomienia sądu dystryktowego (must file, under seal, a notice), w którym zebrała się wielka ława przysięgłych o ujawnieniu tychże informacji i jakim departamentom, służbom (agencies) i podmiotom (entities) zostały ujawnione (reguła 6(e)(3)(D)(ii)).

(E) The court may authorize disclosure—at a time, in a manner, and subject to any other conditions that it directs—of a grand-jury matter:

Sąd może zezwolić (authorize) na ujawnienie informacji w określonym terminie i określony sposób, nakładając dodatkowe warunki do spełnienia/ z zastrzeżeniem dodatkowych warunków do spełnienia (subject to any other conditions that it directs), dotyczących przebiegu postępowania przed wielką ławą przysięgłych (a grand-jury matter):

(i) preliminarily to or in connection with a judicial proceeding;

(i) przed rozpoczęciem lub w związku z postępowaniem sądowym;

(ii) at the request of a defendant who shows that a ground may exist to dismiss the indictment because of a matter that occurred before the grand jury;

(ii) na wniosek oskarżonego, który wskaże podstawę oddalenia aktu oskarżenia na podstawie okoliczności związanej z postępowaniem przed wielką ławą przysięgłych;

(iii) at the request of the government, when sought by a foreign court or prosecutor for use in an official criminal investigation;

(iii) na wiosek prokuratora (government), który współpracuje z sądem lub prokuratorem obcego państwa w celu użycia w oficjalnym śledztwie;

(iv) at the request of the government if it shows that the matter may disclose a violation of State, Indian tribal, or foreign criminal law, as long as the disclosure is to an appropriate state, state-subdivision, Indian tribal, or foreign government official for the purpose of enforcing that law; or

(iv) na wniosek prokuratora (government), jesli wskaże, że okoliczność (the matter) może ujawnić  naruszenie (may disclose a violation) prawa karnego federacji, stanu, plemienia indiańskiego lub obcego państwa pod warunkiem, że (as long as) informacje ujawnione zostaną odpowiedniemu urzędnikowi stanu, jednostki administracyjnej, plemienia indiańskiego lub obcego rządu w celu zapewnienia przestrzegania tego prawa (for the purpose of enforcing that law) lub

(v) at the request of the government if it shows that the matter may disclose a violation of military criminal law (...), as long as the disclosure is to an appropriate military official for the purpose of enforcing that law.

 (v) na wniosek prokuratora (government), jeśli wskaże, że okoliczność może ujawnić  naruszenie prawa karnego wojskowego (military criminal law) pod warunkiem, że informacje ujawnione zostaną odpowiedniemu urzędnikowi wojskowemu w celu zapewnienia przestrzegania tego prawa (reguła 6(e)(3)(E)).

(F) A petition to disclose a grand-jury matter under Rule 6(e)(3)(E)(i) must be filed in the district where the grand jury convened. Unless the hearing is ex parte—as it may be when the government is the petitioner—the petitioner must serve the petition on, and the court must afford a reasonable opportunity to appear and be heard to:
(i) an attorney for the government;
(ii) the parties to the judicial proceeding; and
(iii) any other person whom the court may designate.

Wniosek (a petition) o ujawnienie informacji o przebiegu postępowania przed wielką ławą przysięgłych zgodnie z zasadą 6(e)(3)(E)(i) musi zostać złożony (filed) w dystrykcie, w którym zebrała się (convened) wielka ława przysięgłych. O ile postępowanie nie toczy się udziałem jednej strony (ex parte),– czyli kiedy wnioskodawcą jest prokurator (as it may be when the government is the petitioner), wnioskodawca musi doręczyć odpis wniosku (serve the petition on), a sąd musi zagwarantować możliwość stawienia się i bycia wysłuchanym (afford a reasonable opportunity to appear and be heard to):
(i) prokuratorowi, (ii) stronom postępowania sądowego i (iii) każdej osobie wyznaczonej przez sąd (any other person whom the court may designate) (reguła 6(e)(3)(F)).

(4) Sealed Indictment. The magistrate judge to whom an indictment is returned may direct that the indictment be kept secret until the defendant is in custody or has been released pending trial. The clerk must then seal the indictment, and no person may disclose the indictment's existence except as necessary to issue or execute a warrant or summons.

Sędzia( magistrate judge), który uczestniczy w procedurze postawienia w stan oskarżenia/ przed którym wielka ława przysięgłych stawia w stan oskarżenia (to whom an indictment is returned) może postanowić o utajnieniu aktu oskarżenia (may direct that the indictment be kept secret) dopóki oskarżony jest tymczasowo aresztowany (until the defendant is in custody) lub został zwolniony (has been released) do czasu rozpoczęcia rozprawy (pending trial). Urzędnik sądu (the clerk) utajnia akt oskarżenia (must seal the indictment), a żadna osoba nie ma prawa ujawnić informacji o istnieniu aktu oskarżenia (no person may disclose the indictment's existence) poza sytuacją, gdy jest to niezbędne do wydania (issue) lub wykonania (execute) nakazu sądowego (a warrant) lub wezwania (a summons)  (reguła 6(e)(4)).

tl;dr summary
ü  The federal criminal jury returns a verdict pursuant to (according to) Article III, Section 2, Clause 3 of the Constitution of the United States of America and the Sixth Amendment.
ü  The federal criminal jury may return a verdict in cases related to crimes punishable by over six months in prison and a $500 fine.
ü  The defendant may waive (give up) his right to a jury trial in favor of a bench trial = a trial before a judge.
ü  As a general rule a federal criminal jury consists of 12 persons. One of the exceptions occurs when after the jury has retired to deliberate; one member has to be excused by the judge for good cause (for a good reason, e.g. serious health problems). Then a jury of 11 may return a verdict.
ü  Potential jurors are examined (asked questions) by the court, by the attorney for the parties or by both, the court and the attorneys for the parties during the so called voir dire. As a consequence, potential jurors may be excluded from the proceedings by the court:
ü  when they are unable to render (provide) impartial (objective) jury service;
ü  when they are likely to disrupt the proceedings;
ü  when they are likely to threaten the secrecy of the proceedings, or otherwise (in a different way) adversely (negatively) affect the integrity (the process) of jury deliberations
ü  upon a peremptory challenge  made by one of the parties or
ü  upon a challenge for cause made by one of the parties.
ü  With peremptory challenges the parties do not have to provide a specific reason for excluding the juror. However, such exclusions may not be motivated by the race or gender of the juror. The number of peremptory challenges available to each party depends on the type of crime that the defendant is charged with. (1) In a capital case – when the prosecution seeks the death penalty, each party receives 20 peremptory challenges. (2) In other felony cases – when the defendant is charged with a crime punishable by imprisonment of more than one year, the government has 6 peremptory challenges and the defendant or defendants jointly have 10 peremptory challenges. (3) In a misdemeanor case – when the defendant is charged with a crime punishable by fine, imprisonment of one year or less, or both, each party has 3 peremptory challenges.
ü  A person may be challenged for cause if the examination shows he or she might be prejudiced. There is no limit to the number of challenges for cause, which either party may make.
ü  Jurors cannot take an active part in the proceedings. They may not ask questions or make objections.
ü  Before the jury retires to deliberate, the members are instructed on the law by the court. The parties may request in writing that the court instruct the jury on the specific law. The parties may object to any portion of the instructions or to a failure to give a requested instruction.
ü  The verdict must be unanimous (every member must vote in the same way): guilty or not guilty.
ü  The part of the trial when the judge asks each juror whether he or she agrees with the verdict is called the jury poll.
ü  If the members of the jury cannot agree on the verdict, the court declares a mistrial and the defendant may be later retried (tried again) before a different jury.

MORE TECHNICAL FUN FACTS
ü  Citizen names are taken from voter registration lists, lists of actual voters or other sources in order to form the so called master jury wheel.
ü  Names are drawn from the master jury wheel and the selected people are mailed the so called juror qualification forms, which they fill out and send back to the court.
ü  Prospective (potential) jurors must be citizens of the United States, of age (over 18), residents of a given judicial district for at least a year, able to read, write, understand and speak the English language as well as mentally and physically capable of serving as jurors. They may not have a charge pending against them for a crime punishable by imprisonment for more than one year. Past convicts (people who were convicted in the past) may serve as long as they haven’t lost their civil rights or they have had them restored.
ü  A person is declared unqualified for jury service when they don’t meet at least one of the above conditions.
ü  A person may be excused from jury service on individual request if the service could entail undue hardship or extreme inconvenience to this person or if they are volunteer safety personnel, i.e. firefighters or members of a rescue squad or ambulance crew.

MASTER JURY WHEEL
(a) From time to time as directed by the district court, the clerk or a district judge shall draw at random from the master jury wheel the names of as many persons as may be required for jury service (28 § 1864(a) USC).

In any case in which it appears that there is an omission, ambiguity, or error in a form, the clerk or jury commission shall return the form with instructions to the person to make such additions or corrections as may be necessary and to return the form to the clerk or jury commission within ten days (28 § 1864(a) USC).

 (h) “juror qualification form” shall mean a form prescribed by the Administrative Office of the United States Courts and approved by the Judicial Conference of the United States, which shall elicit the name, address, age, race, occupation, education, length of residence within the judicial district, distance from residence to place of holding court, prior jury service, and citizenship of a potential juror, and whether he should be excused or exempted from jury service, has any physical or mental infirmity impairing his capacity to serve as juror, is able to read, write, speak, and understand the English language, has pending against him any charge for the commission of a State or Federal criminal offense punishable by imprisonment for more than one year, or has been convicted in any State or Federal court of record of a crime punishable by imprisonment for more than one year and has not had his civil rights restored. The form shall request, but not require, any other information not inconsistent with the provisions of this title and required by the district court plan in the interests of the sound administration of justice. The form shall also elicit the sworn statement that his responses are true to the best of his knowledge. Notarization shall not be required. The form shall contain words clearly informing the person that the furnishing of any information with respect to his religion, national origin, or economic status is not a prerequisite to his qualification for jury service, that such information need not be furnished if the person finds it objectionable to do so, and that information concerning race is required solely to enforce nondiscrimination in jury selection and has no bearing on an individual’s qualification for jury service (28 §1869(h) USC).

SANCTIONS RELATED TO THE QUALIFICATION FORM

(b) Any person summoned pursuant to subsection (a) of this section who fails to appear as directed shall be ordered by the district court forthwith to appear and show cause for his failure to comply with the summons. Any person who fails to appear pursuant to such order or who fails to show good cause for noncompliance with the summons may be fined not more than $1,000, imprisoned not more than three days, ordered to perform community service, or any combination thereof. Any person who willfully misrepresents a material fact on a juror qualification form for the purpose of avoiding or securing service as a juror may be fined not more than $1,000, imprisoned not more than three days, ordered to perform community service, or any combination thereof (28 § 1864(b) USC).

Niestawiennictwo przed sądem w celu wypełnienia formularza kwalifikacyjnego skutkuje bezzwłocznym (forthwith) ponownym wezwaniem do sądu (order) i obowiązkiem usprawiedliwienia wcześniejszego niestawiennictwa (show cause for his failure to comply with the summons). DISQUALIFYING POTENTIAL JURORS

(b) In making such determination the chief judge of the district court, or such other district court judge as the plan may provide, or the clerk if the court’s jury selection plan so provides, shall deem any person qualified to serve on grand and petit juries in the district court unless he—
(1) is not a citizen of the United States eighteen years old who has resided for a period of one year within the judicial district;
(2) is unable to read, write, and understand the English language with a degree of proficiency sufficient to fill out satisfactorily the juror qualification form;
(3) is unable to speak the English language;
(4) is incapable, by reason of mental or physical infirmity, to render satisfactory jury service; or
(5) has a charge pending against him for the commission of, or has been convicted in a State or Federal court of record of, a crime punishable by imprisonment for more than one year and his civil rights have not been restored (28 § 1865(b) USC).

QUALIFIED JURY WHEEL

(a) The chief judge of the district court, or such other district court judge as the plan may provide, on his initiative or upon recommendation of the clerk or jury commission, or the clerk under supervision of the court if the court’s jury selection plan so authorizes, shall determine solely on the basis of information provided on the juror qualification form and other competent evidence whether a person is unqualified for, or exempt, or to be excused from jury service. The clerk shall enter such determination in the space provided on the juror qualification form and in any alphabetical list of names drawn from the master jury wheel. If a person did not appear in response to a summons, such fact shall be noted on said list..

Prezes sądu dystrykowego lub inny sędzia (or such other district judge)  wyznaczony w planie selekcji (as the plan may provide), z własnej inicjatywy lub na zalecenie (upon recommendation) urzędnika lub komisji ds. ławy przysięgłych albo urzędnik pod nadzorem sądu, gdy plan selekcji tak stanowi (if the court’s jury selection plan so authorizes), oceni wyłącznie na podstawie informacji zawartych w wypełnionych formularzach kwalifikacyjnych i innego odpowiednio zgromadzonego materiału (other competent evidence), czy dana osoba kwalifikuje się do odbycia służby jako członek ławy przysięgłych, czy może być z niej zwolniona (exempt) ze względu na ochronę zdrowia, bezpieczeństwo lub dobro publiczne albo zwolniona (excused) ze względu na nadmierne trudności (undue hardship) lub wyjątkowe przeszkody (extreme inconvenience) w wypełnianiu obowiązków członka ławy przysięgłych. Urzędnik umieszcza tę informację w polu do tego wyznaczonym w formularzu kwalifikacyjnym, jak również na alfabetycznej liście nazwisk wyłonionych z głównej puli. Na liście umieszcza się również informację o niestawiennictwie po pierwszym wezwaniu sądu (in response to a summons) (tytuł 28 § 1865(a) USC).

SUMMONING POTENTIAL JURORS

(b) When the court orders a grand or petit jury to be drawn, the clerk or jury commission or their duly designated deputies shall issue summonses for the required number of jurors.
Each person drawn for jury service may be served personally, or by registered, certified, or first-class mail addressed to such person at his usual residence or business address (28 § 1866(b) USC).

Kiedy sąd wydaje postanowienie o wylosowaniu  członków wielkiej lub małej ławy przysięgłych, urzędnik lub komisja lub ich należycie wskazani zastępcy (duly designated deputies) wysyłają wezwania sądowe (issue summonses) wymaganej liczbie osób. Wezwania mogą być doręczane (served) osobiście albo listem monitorowanym (registered mail), listem poleconym (certified mail) lub listem zwykłym (first-class mail) na adres miejsca zwykłego pobytu (usual residence) lub adres pracy (business address) członka ławy przysięgłych (tytuł 28 § 1866(b) USC).

EXCUSING POTENTIAL JURORS

(...) specify those groups of persons or occupational classes whose members shall, on individual request therefor, be excused from jury service (...) jury service by such class or group would entail undue hardship or extreme inconvenience to the members thereof (...) (28 § 1863b5A USC).

Plan selekcji powinien również wskazać członków grup społecznych lub zawodowych, którzy na indywidualny wniosek (on individual request) będą mogli zostać zwolnieni (excused) z obowiązku zasiadania w ławie przysięgłych (jury service) ze względu na nadmierne trudności (undue hardship) lub wyjątkowe przeszkody (extreme inconvenience) w wypełnianiu obowiązków członka ławy przysięgłych (tytuł 28 § 1863b5A USC).

That any person summoned for jury service may be (1) excused by the court, or by the clerk under supervision of the court if the court’s jury selection plan so authorizes, upon a showing of undue hardship or extreme inconvenience, for such period as the court deems necessary, at the conclusion of which such person either shall be summoned again for jury service under subsections (b) and (c) of this section or, if the court’s jury selection plan so provides, the name of such person shall be reinserted into the qualified jury wheel for selection (…)

Osoba wezwana do odbycia służby w ławie przysięgłych może (1) być zwolniona (excused) przez sąd lub przez urzędnika pod nadzorem sądu jeśli plan selekcji na to zezwala/ tak stanowi, gdy osoba ta dowiedzie (upon a showing), że zasiadanie w ławie wiązałoby się z  nadmiernymi trudnościami lub, że istnieją wyjątkowe przeszkody, na okres, który sąd uzna za konieczny i z końcem którego osoba zostanie ponownie wezwana do pełnienia obowiązków członka ławy przysięgłych  albo, gdy plan selekcji przewiduje taką możliwość (if the court’s jury selection plan so provides) nazwisko osoby zostanie ponownie umieszczone na liście zakwalifikowanych kandydatów (tytuł 28 § 1866(c) USC).

 (...) specify that volunteer safety personnel, upon individual request, shall be excused from jury service. For purposes of this subparagraph, the term “volunteer safety personnel” means individuals serving (...) as firefighters or members of a rescue squad or ambulance crew (28 § 1863(b)(5)(B) USC).

Plan selekcji powinien zawierać postanowienie zwalniające członków publicznych służb ochotniczych na ich indiwidualny wniosek z obowiązku zasiadania w ławie przysięgłych. W niniejszym punkcie paragrafu określenie członkowie publicznych służb ochotniczych oznacza osoby pełniące służbę w (…) straży pożarnej, ratowniczej i pogotowiu ratunkowym (tytuł 28 § 1863(b)(5)(B) USC).

EXEMPTING POTENTIAL JURORS

 (...) specify that the following persons are barred from jury service on the ground that they are exempt: (A) members in active service in the Armed Forces of the United States; (B) members of the fire or police departments (...) JURY TRIAL OR BENCH TRIAL

Rule 23. Jury or Nonjury Trial (Federal Rules of Criminal Procedure)
23(a) Jury Trial. If the defendant is entitled to a jury trial, the trial must be by jury unless:
(1) the defendant waives a jury trial in writing;
(2) the government consents; and
(3) the court approves.

Gdy oskarżonemu przysługuje proces z udziałem ławy przysięgłych, postępowanie przebiega z udziałem ławy przysięgłych chyba, że (1) oskarżony pisemnie zrzeknie się prawa (waives) do procesu z udziałem ławy przysięgłych; (2) oskarżyciel publiczny (the government)  wyrazi  na to zgodę a (3) sąd na to zezwoli (reguła 23(a)).

JURY SIZE

23(b) Jury Size.
(1) In General. A jury consists of 12 persons unless this rule provides otherwise.
(2) Stipulation for a Smaller Jury. At any time before the verdict, the parties may, with the court's approval, stipulate in writing that:
(A) the jury may consist of fewer than 12 persons; or
(B) a jury of fewer than 12 persons may return a verdict if the court finds it necessary to excuse a juror for good cause after the trial begins.
(3) Court Order for a Jury of 11. After the jury has retired to deliberate, the court may permit a jury of 11 persons to return a verdict, even without a stipulation by the parties, if the court finds good cause to excuse a juror.

(1) Ława przysięgłych składa się z dwunastu członków, o ile przepisy nie stanowią inaczej (unless this rule provides otherwise). (2) W dowolnym momencie przed ogłoszeniem werdyktu, za zgodą sądu, strony mogą pisemnie postanowić, że (A) ława przysięgłych będzie liczyła mniej niż dwunastu członków lub (B) ława przysięgłych licząca mniej niż dwunastu członków może wydać werdykt w przypadku, gdy według sądu konieczne jest zwolnienie (excuse) jej członka z przyczyn uzasadnionych (for good cause) po rozpoczęciu rozprawy głównej (after the trial begins). BENCH TRIAL

23(c) Nonjury Trial. In a case tried without a jury, the court must find the defendant guilty or not guilty. If a party requests before the finding of guilty or not guilty, the court must state its specific findings of fact in open court or in a written decision or opinion.

W postępowaniu bez udziału ławy przysięgłych sąd orzeka o winie lub braku winy oskarżonego (find the defendant guilty or not guilty). Na wniosek strony o uzasadnienie orzeczenia złożony przed jego ogłoszeniem, sąd uzasadnia orzeczenie ze wskazaniem ustaleń faktycznych (specific findings of fact), na których ono się opiera ustnie na rozprawie (in open court) lub pisemnie w formie wyroku/decyzji lub opinii (reguła 23(c)).

Rule 24. Trial Jurors
(a) Examination.
(1) In General. The court may examine prospective jurors or may permit the attorneys for the parties to do so.
(2) Court Examination. If the court examines the jurors, it must permit the attorneys for the parties to:
(A) ask further questions that the court considers proper; or
(B) submit further questions that the court may ask if it considers them proper.

Osoba (2) może być wyłączona (excluded) przez sąd z obowiązku zasiadania w ławie na podstawie istnienia obawy, że osoba ta może być niezdolna do zachowania bezstronności (unable to render impartial jury service) lub może zakłócić przebieg postępowania (likely to disrupt proceedings). Osoba może być również wyłączona (excluded) (3) na podstawie wniosku peremptoryjnego (peremptory challenge) w formie przewidzianej prawem lub (4) na podstawie wniosku z uzasadnieniem (a challenge for cause) którejkolwiek ze stron zgodnie przepisami prawa (specified by law). Na mocy przepisu 28 § 1866(c)(5) USC wyłączenie może również nastąpić ze względu na ustalenie przez sąd, że zasiadanie tej osoby w ławie przysięgłych zagraża tajności postępowania (likely to threaten the secrecy of the proceedings) lub może mieć negatywny wpływ innego rodzaju na przebieg narady członków ławy przysięgłych (otherwise adversely affect the integrity of jury deliberations (...) (tytuł 28 § 1866(c) USC)

PEREMPTORY CHALLENGES

(b) Peremptory Challenges. Each side is entitled to the number of peremptory challenges to prospective jurors specified below. The court may allow additional peremptory challenges to multiple defendants, and may allow the defendants to exercise those challenges separately or jointly.
(1) Capital Case. Each side has 20 peremptory challenges when the government seeks the death penalty.
(2) Other Felony Case. The government has 6 peremptory challenges and the defendant or defendants jointly have 10 peremptory challenges when the defendant is charged with a crime punishable by imprisonment of more than one year.
(3) Misdemeanor Case. Each side has 3 peremptory challenges when the defendant is charged with a crime punishable by fine, imprisonment of one year or less, or both.

Każda ze stron dysponuje (is entitled to) określoną poniżej (specified below) liczbą wniosków peremptoryjnych o wyłączenie potencjalnego członka ławy przysięgłych. Sąd może zezwolić na dodatkowe wnioski peremptoryjne, gdy oskarżonych jest więcej i może określić, że oskarżeni korzystają z wniosków osobno lub wspólnie (reguła 24(b))
(1) Każda ze stron dysponuje dwudziestoma wnioskami peremptoryjnymi, kiedy oskarżenie dotyczy przestępstwa, za które ustawa przewiduje karę śmierci (capital case) (reguła 24(b)(1)).
(2) Oskarżyciel (the government) dysponuje sześcioma wnioskami peremptoryjnymi, a oskarżony lub oskarżeni wspólnie dysponują dziesięcioma wnioskami peremporyjnymi, kiedy oskarżenie dotyczy przestępstwa, za które ustawa przewiduje karę ponad roku pozbawienia wolności (felony case) (reguła 24(b)(2)).
(3) Każda ze stron dysponuje trzema wnioskami peremptoryjnymi, kiedy oskarżenie dotyczy przestępstwa, za które ustawa przewiduje karę grzywny, pozbawienia wolności jednego roku lub krótszej lub łącznie kary grzywny i pozbawienia wolności (misdemeanor case) (reguła 24(b)(3)).

JURY INSTRUCTIONS

Rule 30. Jury Instructions
(a) In General. Any party may request in writing that the court instruct the jury on the law as specified in the request. The request must be made at the close of the evidence or at any earlier time that the court reasonably sets. When the request is made, the requesting party must furnish a copy to every other party.

Strona może pisemnie wnieść o poinstruowanie ławy przysięgłych o obowiązywaniu  konkretnych przepisów (on the law as specified in the request). Wniosek musi być złożony na koniec postępowania dowodowego (at the close of the evidence) lub w dowolnej chwili poprzedzającej ten moment (at any earlier time) wskazanej przez sąd. Strona wnosząca udostępnia odpis wniosku pozostałym stronom (must furnish a copy to every other party) (reguła 30 (a)).

(b) Ruling on a Request. The court must inform the parties before closing arguments how it intends to rule on the requested instructions.

Przed przemowami końcowymi (before closing arguments)  obu stron sąd informuje je, czy uwzględnia czy odrzuca wniosek o poinstruowanie ławy przysięgłych (how it intends to rule on the requested instructions) (reguła 30 (b)).

(c) Time for Giving Instructions. The court may instruct the jury before or after the arguments are completed, or at both times.

Sąd może poinstruować ławę przysięgłych przed rozpoczęciem przemówień końcowych, po ich zakończeniu lub w obu stadiach rozprawy (reguła 30 (c)).

(d) Objections to Instructions. A party who objects to any portion of the instructions or to a failure to give a requested instruction must inform the court of the specific objection and the grounds for the objection before the jury retires to deliberate. An opportunity must be given to object out of the jury's hearing and, on request, out of the jury's presence. Failure to object in accordance with this rule precludes appellate review, except as permitted under Rule 52(b).

Strona, która sprzeciwia się (objects to) dowolnej części (any portion of) instrukcji lub nieudzieleniu instrukcji, o którą wcześniej wnosiła (a failure to give a requested instruction), informuje sąd o konkretnym zarzucie (the specific objection) i jego podstawach zanim ława przysięgłych uda się na naradę (retires to deliberate). Strona musi mieć możliwość podnieść zarzut nie będąc słyszanym przez członków ławy przysięgłych (out of the jury's hearing) i pod nieobecność ławy (out of the jury's presence), jeśli o to wniesie (on request). Strona, która nie podniesie zarzutu wobec instrukcji sędziego zgodnie z z niniejszym przepisem (Failure to object in accordance with this rule), nie może powołać się na instrukcje sędziego jako przyczynę odwoławczą (precludes appellate review) z wyjątkiem w sposób, jaki przewiduje reguła 52(b) (except as permitted under Rule 52(b)) (reguła 30 (d)).

JURY VERDICT

Rule 31. Jury Verdict
(a) Return. The jury must return its verdict to a judge in open court. The verdict must be unanimous.

Ława przysięgłych musi wydać werdykt (return a verdict) wobec obecności sędziego (to a judge) na rozprawie jawnej (in open court). Werdykt musi być jednomyślny (unanimous) (reguła 31(a))

(b) Partial Verdicts, Mistrial, and Retrial.
(1) Multiple Defendants. If there are multiple defendants, the jury may return a verdict at any time during its deliberations as to any defendant about whom it has agreed.

Jeśli w sprawie występuje więcej niż jeden oskarżony, ława może wydać werdykt dotyczący/ w stosunku do jednego z nich (as to any defendant) w dowolnym momencie w trakcie swojej narady (at any time during its deliberations), gdy osiągnie co do niego jednomyślność (about whom it has agreed) (reguła 31(b)(1)).

(2) Multiple Counts. If the jury cannot agree on all counts as to any defendant, the jury may return a verdict on those counts on which it has agreed.

Jeśli ława przysięgłych nie może uzyskać jednomyślności w stosunku do wszystkich zarzutów (counts) któregoś z oskarżonych, ława przysięgłych może wydać werdykt dotyczący zarzutów (on those counts) co do których osiągnęła jednomyślność (on which it has agreed) (reguła 31(b)(2)).
(3) Mistrial and Retrial. If the jury cannot agree on a verdict on one or more counts, the court may declare a mistrial on those counts. The government may retry any defendant on any count on which the jury could not agree.

Jeśli ława przysięgłych nie może uzyskać jednomyślności (cannot agree) w stosunku do jednego lub kilku zarzutów, sąd może unieważnić przewód sądowy co do tych zarzutów (declare a mistrial). Oskarżyciel (the government) może ponownie wnieść zarzuty (retry any defendant), co do których ława przysięgłych nie osiągnęła jednomyślności (on any count on which the jury could not agree) (reguła 31(b)(3))

(c) Lesser Offense or Attempt. A defendant may be found guilty of any of the following:
(1) an offense necessarily included in the offense charged;
(2) an attempt to commit the offense charged; or
(3) an attempt to commit an offense necessarily included in the offense charged, if the attempt is an offense in its own right.

Oskarżony może zostać uznany za winnego (found guilty): (1) popełnienia przestępstwa zagrożonego niższym wymiarem kary i naruszającego to samo dobro co przestępstwo określone w akcie oskarżenia (offense necessarily included in the offense charged); (2) usiłowania popełnienia przestępstwa określonego w akcie oskarżenia (an attempt to commit the offense charged); (3) usiłowania popełnienia czynu zagrożonego niższym wymiarem kary i naruszającego to samo dobro co przestępstwo określone w akcie oskarżenia, jeśli samo usiłowanie stanowi osobne przestępstwo (an attempt to commit an offense necessarily included in the offense charged) (reguła 31(c))

(d) Jury Poll. After a verdict is returned but before the jury is discharged, the court must on a party's request, or may on its own, poll the jurors individually. If the poll reveals a lack of unanimity, the court may direct the jury to deliberate further or may declare a mistrial and discharge the jury. 

Po wydaniu werdyktu i przed zwolnieniem członków ławy przysięgłych z dalszego pełnienia obowiązków (before the jury is discharged), sąd musi na wniosek strony (on a party’s request) lub może z własnej inicjatywy (on its own) poprosić każdego członka ławy przysięgłych z osobna o potwierdzenie werdyktu (poll the jurors individually). Jeśli wyjdzie na jaw brak jednomyślności (a lack of unanimity), sąd może nakazać członkom ławy przysięgłych, aby powrócili do obradowania (deliberate further) lub może uznać przewód sądowy za nieważny (declare a mistrial) i zwolnić członków ławy przysięgłych z dalszego pełnienia obowiązków (discharge the jury) (reguła 31(d)).
